In accordance with the Digital Millennium Copyright Act (“DMCA”), including 17 U.S.C. § 512, 4 Better Health has established the following procedure for receiving and responding to notices of alleged copyright infringement involving material appearing on or accessible through our website or online services.

Copyright Infringement Notification

If you are a copyright owner, or are authorized to act on behalf of a copyright owner, and believe that copyrighted material has been copied, posted, displayed, linked, or otherwise made available through our website in a manner that constitutes copyright infringement, you may submit a written DMCA notice to our designated agent.

To be effective, your notice should include substantially the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner;
  2. Identification of the copyrighted work claimed to have been infringed or, if multiple copyrighted works are involved, a representative list of those works;
  3. Identification of the material that you claim is infringing or is the subject of infringing activity, together with information reasonably sufficient to allow us to locate the material, such as the specific URL or webpage on which it appears;
  4. Information reasonably sufficient to permit us to contact you, including your name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or applicable law; and
  6. A statement that the information contained in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Notices of claimed copyright infringement should be directed to:

Our Response to Copyright Notices

Upon receipt of a notice that substantially complies with the requirements of the DMCA, 4 Better Health may remove or disable access to the material identified in the notice as allegedly infringing.

When applicable, we will take reasonable steps to notify the individual or entity that provided or posted the affected material.

4 Better Health reserves the right to remove or disable access to material when we have actual knowledge of infringement or become aware of facts or circumstances indicating that infringing activity is apparent.

Counter-Notification

If material you provided has been removed or access to it has been disabled as a result of a DMCA notice, and you believe the material was removed or disabled because of mistake or misidentification, you may submit a written counter-notification to our designated DMCA Agent.

The counter-notification should include:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed or to which access was disabled and the location where the material appeared before it was removed or disabled;
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number; and
  5. A statement that you consent to the jurisdiction of the appropriate United States Federal District Court as required by 17 U.S.C. § 512(g), and that you will accept service of process from the person who submitted the original infringement notification or an agent of that person.

After receiving a valid counter-notification, 4 Better Health may restore the affected material in accordance with the procedures and time periods established by the DMCA unless the party who submitted the original notice informs us that it has filed an action seeking a court order to restrain the alleged infringement.

Repeat Infringers

In appropriate circumstances and at our discretion, 4 Better Health may restrict or terminate access to our online services by users who repeatedly infringe the copyrights or other intellectual property rights of others.

Misrepresentations

Please be aware that the DMCA may impose liability on persons who knowingly and materially misrepresent that material or activity is infringing or that material was removed or disabled by mistake or misidentification.

Before submitting a DMCA notice or counter-notification, you may wish to consult an attorney regarding your rights and obligations under federal copyright law.

No Waiver of Rights

Nothing in this notice is intended to waive any rights, remedies, limitations of liability, defenses, immunities, or protections available to 4 Better Health under the DMCA, the Copyright Act, or any other applicable federal or state law.

4 Better Health reserves all such rights and remedies.
